Information on the entry into force of the obligation on August 1 of this year has spread in social networks. advanced training for all drivers driving vehicles owned by legal entities. In particular, the information focused on two circumstances: Firstly, this is dissatisfaction related to the possibility of advanced driver training exclusively with Avtotest Report LLC;
Secondly, the extension of the mandatory requirement for advanced training is not applicable to all legal entities, but only to persons involved in freight and passenger transportation.
In order to take effective and effective measures to prevent violations during the operation of vehicles, increase the responsibility of drivers of vehicles for observing traffic rules, as well as create equal conditions for business entities in the preparation, retraining and advanced training of drivers of vehicles, a resolution of the Cabinet of Ministers from 02/23/2018 No. 139 “On measures to improve the system of training, retraining and advanced training of drivers of motor vehicles”.
So, according to the decree:
- in accordance with paragraph 1, it is established that from August 1, 2018, training, retraining and advanced training of drivers of motor vehicles and urban electric vehicles is carried out by state educational institutions, as well as other legal entities licensed to carry out activities of non-governmental educational institutions;
- in accordance with paragraph 3, persons who drive vehicles owned by legal entities, with the exception of individual entrepreneurs and other individuals who drive vehicles on the basis of short-term rental (rental) and leasing, must undergo advanced training once every two years.
Appendix No. 2 to this resolution excludes paragraph 2, paragraph 2 of the Cabinet of Ministers resolution dated April 30, 2015 No. 106 “On measures to improve the educational process and introduce modern training methods in the system of training and retraining drivers of motor vehicles and urban electric vehicles in the Republic Uzbekistan ”.
So, based on the foregoing, Avtotest Report LLC and its subordinate organizations have lost a separate right to provide advanced training services for drivers who drive vehicles owned by legal entities.
Based on this, persons (drivers) driving vehicles owned by legal entities have the right to improve their qualifications in any educational institution that has the appropriate license.
At the same time, today, the only organization licensed to provide advanced training services for drivers of vehicles owned by legal entities is Avtotest Report LLC and its subordinate organizations.
Based on the foregoing, and also taking into account the fact that Avtotest Report LLC has been operating in the market for providing professional development services for motor vehicle drivers for more than one year, the Antimonopoly Committee is conducting a study to include Avtotest Report LLC in the register of enterprises holding exclusive position.
In addition, the obligation to improve the skills of persons driving vehicles owned by legal entities at least once every two years is taken in order to ensure the safety of the road, life and health of citizens, to strengthen measures to prevent traffic accidents and not only applies on legal entities carrying out activities on the transport of goods and passengers, but also on all legal entities that have at their disposal (balance) a vehicle.
Subjects who have concluded that this requirement infringes on the rights and interests of legal entities have the right to apply to the body that adopted the legislative act or to the Constitutional Court of the Republic of Uzbekistan with a request to cancel the mandatory training of drivers of motor vehicles belonging to legal entities.
