The Surkhandarya Territorial Office of the Antimonopoly Committee has studied the rationale of Termiz Neft Bazasi LLC for additional payment for the shipment of fuel products through exchange trading.
According to the Decree of the President of the Republic of April 4, 2020 No. PP-4664 “On priority measures to improve the financial stability of the oil and gas industry” of May 1, 2020, state regulation of retail prices for AI-80 gasoline and diesel fuel (including ECO diesel fuel) has been canceled. Oil refineries must sell these products only through exchange trading.
Based on the results of the study, it was found out that Termiz Neft Bazasi LLC, in the period May-June 2020, sold 194.58 tons of fuel products under 71 contracts at exchange auctions. And for the shipment of these products to the consumer, Termiz Neft Bazasi LLC unreasonably “earned” 122.7 million soums.
In the above actions of Termiz Neft Bazasi LLC, signs of violation of the 36th clause of the Regulation “On the procedure for the formation, declaration (approval) and establishment of regulated prices (tariffs) for goods (work, services) and state control over their application”, approved by the Resolution of the Cabinet of Ministers dated 28.10.2010 No. 239. In accordance with the established procedure, the Surkhandarya territorial administration opened a case.
In accordance with the Resolution of the special commission of the territorial administration in the case of Termiz neft bazasi LLC, an order was issued to return to consumers unreasonably received funds in the amount of 122.7 million soums.
